01Who we are

Vinko Visuals is a brand identity and web design studio based in Montréal, Québec, run by Jamil Fayad. In this policy, "we" and "us" mean Vinko Visuals.

Under Québec's Act respecting the protection of personal information in the private sector (amended by Law 25), every business has a person in charge of protecting personal information. For us, that is:

Jamil Fayad
Founder · Person in charge of the protection of personal information
vinkovisuals@gmail.com · 514-452-1318
Montréal, Québec

02What we collect

When you send the contact form

Your name, email, business name, phone number (optional), current website or Instagram (optional), project type, budget, launch timeline, what you tell us about your business, whether you want a free homepage concept, and the language you used.

When you book a call, email or phone us

Your name, contact details and what you choose to tell us. Calls are booked through Cal.com.

When you become a client

Your contact and billing details, your contract, invoices and payments, and the content you give us for your site (text, photos, logos, logins we need to set up your domain or services).

When you visit the site

Like every website, our host receives technical information to deliver the pages: your IP address, browser type and the pages requested. With your permission only, analytics and advertising cookies also collect how you use the site (see Cookies).

We don't ask for sensitive information (such as health or financial account details), and we ask you not to send it.

03Why we use it

  • To reply to your request, prepare a quote or a free homepage concept, and book calls.
  • To design, build, launch and maintain your website or brand, and to bill you.
  • To meet our legal obligations, such as keeping accounting records.
  • With your permission only: to measure visits to the site and the results of our ads, so we can improve both.

We only use your information for these purposes. If we ever want to use it for something else, we'll ask you first. We don't make decisions about you based only on automated processing.

04How we collect it

We collect information directly from you: through the form, by email, by phone, when you book a call, or during a project. By sending us your information for one of the purposes above, you consent to us using it for that purpose.

You don't have to give us your information, but without your name and email we can't reply to your request. Optional fields are marked as optional.

Our services are meant for businesses and adults. We don't knowingly collect information from anyone under 14.

05Cookies

Cookies are small files saved in your browser. Our site uses a few that it needs to work. Analytics and advertising cookies are off by default: they only turn on if you choose "Accept" in our cookie banner, and you can change your choice at any time.

We may also share information when the law requires it, or with professionals who are bound to confidentiality (such as an accountant or a lawyer).

07Information stored outside Québec

Some of our service providers store information outside Québec, mainly in the United States. Before we use a provider that stores information outside Québec, we assess whether your information will be adequately protected, and we use providers that protect it with security measures and contracts. Information stored in another country may be accessible to authorities there under local law.

08How long we keep it

  • Requests that don't become a project (form, emails, call bookings): up to 2 years after our last exchange, then deleted.
  • Client files (contracts, invoices, payments): 6 years after the end of the year they relate to, as tax laws require.
  • Project content (text, images, logins): for the length of the project and any care plan, then returned or deleted on request.
  • Analytics data: 14 months in Google Analytics.

When information is no longer needed, we delete it or make it anonymous.

09How we protect it

We protect your information with measures that fit how sensitive it is: accounts protected by strong passwords and two-step verification, encrypted connections (HTTPS) on the whole site, access limited to the person in charge, and providers that encrypt the information they store.

If an incident ever puts your personal information at risk of serious harm, we'll tell you and the Commission d'accès à l'information du Québec, as the law requires. We keep a record of all incidents.

10Your rights

You can ask us at any time to:

  • Tell you what information we have about you and give you a copy.
  • Correct information that is wrong, incomplete or out of date.
  • Delete information we no longer need, or that we collected or used against the law.
  • Withdraw your consent, for example to stop receiving messages from us or to turn off cookies.
  • Stop sharing your information, or remove a link to it, when this causes you harm.
  • Give you the information you provided to us in a common digital format, or send it to another organization.

To make a request, email vinkovisuals@gmail.com. We may ask you to confirm your identity. We reply within 30 days, and it's free.

11Questions and complaints

If you have a question or a complaint about how we handle your information, contact Jamil Fayad at vinkovisuals@gmail.com or 514-452-1318. We'll look into it and answer you in writing within 30 days.

If you aren't satisfied with our answer, you can file a complaint with the Commission d'accès à l'information du Québec.

12Changes to this policy

We may update this policy, for example when we add a new tool. The date at the top shows the last change. If a change affects how we use information you already gave us, we'll let you know.
